Welcome to App My Community.

These Website Terms of Service (“Terms”) govern your access to and use of the
websites operated by Armstrong Software, LLC, doing business as App My Community
(“AMC,” “Company,” “we,” “us,” or “our”), including www.appmycommunity.com,
www.resortnavigator.net, www.armstrongsoft.com, and any other websites or online
properties we operate that link to these Terms (collectively, the “Websites”).
By accessing or using any of the Websites, you agree to be bound by these Terms. If
you do not agree, please do not access or use the Websites.
1. Scope and Relationship to Other Agreements
These Terms apply solely to your access to and use of the Websites and all content,
information, materials, features, and functionality made available on or through them.
These Terms do not govern AMC’s mobile applications (which are governed by the
applicable End User License Agreement) or AMC’s subscription-based products and
services provided to customers (which are governed by the applicable Master Services
Agreement, Order Form, and related terms and conditions). If you are an AMC
customer or an end user of an AMC-powered application, separate agreements, terms
of service, or terms and conditions may apply in addition to these Terms.
2. Permitted Use of the Websites
You may access and use the Websites for lawful informational, personal, and business
purposes only.
You agree that you will not, and will not attempt to:
 Use the Websites in violation of any applicable law or regulation;
 Use the Websites for fraudulent, misleading, defamatory, or deceptive purposes;
 Interfere with, disrupt, or compromise the integrity, security, or performance of the
Websites or any related systems or networks;
 Attempt to gain unauthorized access to any portion of the Websites, accounts,
servers, databases, or infrastructure;
 Attempt to test, scan, or probe the vulnerability of the Websites without
authorization;

 Use bots, crawlers, scrapers, data mining tools, or other automated means to
access, monitor, or copy Website content;
 Introduce viruses, malware, ransomware, or other harmful code;
 Reverse engineer, decompile, disassemble, or attempt to derive source code
from any part of the Websites;
 Frame, mirror, or otherwise replicate the design or presentation of the Websites;
 Collect or harvest personal information from the Websites;
 Use the Websites to develop, promote, or assist a competing product or service;
 Use the Websites for any purpose that could harm AMC’s reputation or business
interests.
We reserve the right to suspend or terminate access to the Websites if we reasonably
believe these Terms have been violated.
3. Intellectual Property and Website Content
All content available on the Websites, including text, graphics, images, photographs,
audiovisual materials, logos, trademarks, service marks, trade names, software,
interface elements, layout, design, and other materials (collectively, “Website
Content”), is owned by or licensed to AMC and is protected by intellectual property and
other applicable laws.
Except for the limited right to access and view the Websites for their intended purposes,
no license or other rights are granted to you. You may not reproduce, distribute, publicly
display, modify, create derivative works of, transmit, publish, or otherwise exploit any
Website Content without AMC’s prior written consent. You may not remove or alter
proprietary notices or use AMC’s trademarks or branding without authorization. All
goodwill arising from use of AMC’s trademarks inures solely to AMC.
4. Information You Provide to Us
The Websites may allow you to submit information, including through contact forms,
demo requests, event registrations, newsletter sign-ups, or similar features. By
submitting information through the Websites, you represent that the information is
accurate and that you have the right to provide it, and you agree that AMC may use
such information for legitimate business purposes consistent with our Privacy Policy.
Unless otherwise expressly agreed in writing, communications you initiate through the
Websites are not confidential. If you provide suggestions, ideas, feedback, or
recommendations regarding AMC’s products or services (“Feedback”), you grant AMC
a perpetual, irrevocable, worldwide, royalty-free right to use, modify, incorporate, and
commercialize such Feedback without restriction or compensation. The Websites are
not intended for submission of highly sensitive or confidential information, and you are
responsible for any information you voluntarily provide.

5. Privacy
Your use of the Websites is subject to our Privacy Policy, which describes how we
collect, use, and protect information in connection with the Websites. The Privacy Policy

6. Third-Party Links and Services
The Websites may contain links to third-party websites, services, tools, or resources
that are not owned or operated by AMC. These links are provided for convenience only.
We do not endorse, monitor, or assume responsibility for third-party content, services,
products, or practices. Any interaction you have with third-party websites is solely
between you and that third party and is subject to their terms and policies. AMC does
not control and is not responsible for the content, privacy practices, or terms of any
third-party websites.
7. Disclaimer of Warranties
THE WEBSITES AND ALL WEBSITE CONTENT ARE PROVIDED ON AN “AS IS” AND
“AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMC
DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR
OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A
PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES
ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. AMC DOES NOT
WARRANT THAT THE WEBSITES WILL BE UNINTERRUPTED, ERROR-FREE,
SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT
ANY INFORMATION PROVIDED IS COMPLETE, ACCURATE, OR CURRENT. YOUR
USE OF THE WEBSITES IS AT YOUR OWN RISK.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT
SHALL AMC OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS,
LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT,
INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES,
OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITY, DATA, OR
GOODWILL, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF,
OR INABILITY TO USE, THE WEBSITES OR WEBSITE CONTENT, WHETHER
BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR
ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH
DAMAGES. WITHOUT LIMITING THE FOREGOING, AMC’S TOTAL AGGREGATE
LIABILITY FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THE
WEBSITES SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). SOME
JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PORTIONS OF THIS
SECTION MAY NOT APPLY TO YOU.
9. Indemnification

You agree to indemnify, defend, and hold harmless AMC and its affiliates, officers,
directors, employees, agents, licensors, and service providers from and against any
claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including
reasonable attorneys’ fees) arising out of or relating to your violation of these Terms,
your misuse of the Websites, your violation of applicable law, or any information or
materials you submit through the Websites. AMC reserves the right to assume exclusive
defense and control of any matter subject to indemnification, and you agree to
cooperate with AMC in defending such claims.
10. Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. Any dispute, claim, or controversy arising
out of or relating to these Terms or your use of the Websites shall be resolved by
binding arbitration administered by a recognized arbitration provider in accordance with
its applicable rules. Arbitration shall take place in Missouri, unless otherwise required by
law. You and AMC agree that disputes will be resolved on an individual basis only and
not as part of any class, collective, consolidated, or representative proceeding. YOU
WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS-WIDE
ARBITRATION. Notwithstanding the foregoing, either party may seek injunctive relief in
a court of competent jurisdiction for claims involving intellectual property infringement or
misuse.
11. International Users
The Websites are operated from the United States. If you access the Websites from
outside the United States, you do so at your own initiative and are responsible for
compliance with local laws. You understand that information you provide may be
transferred to and processed in the United States and other jurisdictions where AMC or
its service providers operate.
12. Export Compliance
You may not use, export, or re-export any Website Content or related technology in
violation of U.S. export laws or regulations. You represent that you are not located in,
under the control of, or a national or resident of any country subject to U.S. embargoes
or sanctions, and that you are not identified on any U.S. government restricted-party list.
13. Copyright Complaints (DMCA Notice)
AMC respects the intellectual property rights of others and expects users of the
Websites to do the same. If you believe that content on the Websites infringes your
copyright, you may submit a written notification that includes: (i) your physical or
electronic signature; (ii) identification of the copyrighted work claimed to have been
infringed; (iii) identification of the allegedly infringing material and sufficient information
to permit us to locate it; (iv) your contact information, including address, telephone
number, and email address; (v) a statement that you have a good faith belief that the
disputed use is not authorized by the copyright owner, its agent, or the law; and (vi) a

statement, under penalty of perjury, that the information in your notice is accurate and
that you are authorized to act on behalf of the copyright owner. Notices should be sent
to: [Insert Designated DMCA Agent Contact Information]. AMC may remove or disable
access to allegedly infringing content in accordance with applicable law.
14. Modifications to the Websites or Terms
AMC may modify, suspend, or discontinue any aspect of the Websites at any time
without notice. We may also revise these Terms from time to time. Updated Terms will
be posted with a revised Effective Date, and your continued use of the Websites
constitutes acceptance of the updated Terms.
15. Governing Law and Venue
Subject to the Arbitration and Class Action Waiver section above, these Terms are
governed by the laws of the State of Missouri, without regard to conflict of law
principles. Any dispute arising out of or relating to these Terms or the Websites shall be
brought exclusively in the state or federal courts located in Missouri, and you consent to
such jurisdiction and venue.
16. Electronic Communications
By accessing or using the Websites, submitting information through the Websites, or
communicating with AMC electronically, you consent to receive communications from
AMC electronically, including by email or by posting notices on the Websites. You agree
that all agreements, notices, disclosures, and other communications that AMC provides
to you electronically satisfy any legal requirement that such communications be in
writing. You are responsible for maintaining current and accurate contact information,
including your email address, and for regularly reviewing communications from AMC.
17. Miscellaneous
These Terms constitute the entire agreement between you and AMC regarding the
Websites and supersede all prior or contemporaneous communications. If any provision
is found unenforceable, the remaining provisions remain in effect. If any provision of
these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of
competent jurisdiction, that provision shall be enforced to the maximum extent
permissible and, if necessary, modified to reflect the parties’ original intent as closely as
possible, and the remaining provisions of these Terms shall remain in full force and
effect. The failure of AMC to enforce any right or provision of these Terms shall not
constitute a waiver of such right or provision. AMC may assign these Terms without
restriction; you may not assign them without prior written consent. Nothing herein
creates any partnership, joint venture, agency, or employment relationship.
